Public Assistance (PA) Eligibility
Eligible Organizations
- State government organizations (e.g. departments, agencies, boards, commissions, universities)
- Local government organizations (e.g. counties, townships, cities, villages, districts)
- Private nonprofit (PNP) organizations (e.g. utilities, medical, custodial care, educational)
- Native American tribes and tribal organizations
Work Eligibility Criteria
In general, eligible work is based on the following minimum criteria :
- It must be required as a result of the federally declared event (pre-existing damage is not covered nor is damage from an unrelated event at the time of the disaster).
- It must be located within the designated disaster area.
- It must be the legal responsibility of an eligible applicant.
- No other federal agency has statutory authority to provide funding for the work.
Two types of work are eligible for the Public Assistance Program: Emergency Work and Permanent Work.
- Emergency Work includes debris removal and emergency protective measures
Debris Removal - Eligible when necessary to:
- Eliminate an immediate threat to life, public health and safety; or
- Eliminate an immediate threat of significant damage to improved property; or
- Ensure the economic recovery of the affected community.
Emergency Protective Measures are actions taken to save lives, protect public health and safety, and to protect improved property.
- Permanent Work refers to any activity that must be performed to restore the damaged part of a facility to pre-disaster condition and function. The facility may be replaced if the cost of repair is more than 50 percent of replacement cost.
Cost Eligibility Criteria
Eligible Force Account Costs:
- Applicant's labor, including salary and fringe benefits.
- Applicant's equipment use at appropriate rates. [Note: Cost of regular time labor for permanent employees performing debris removal and emergency protective measures is not eligible.]
- Actual cost of purchased materials.
Contract Costs:
- Reasonable and necessary costs to perform eligible work.
- All contracting and procurement laws must be followed.
- Contracting is the responsibility of the applicant.
